RoyalsTM Items Terms and Conditions

For any points redeemed for merchandise, game tickets, parking passes, game programs, gift cards or any other items from any of the RoyalsTM Items-2012 such items will be delivered by standard shipping methods and may not be shipped to a post office box address. Shi p.m.ents to addresses outside the continental United States of America will require the payment by you of additional postage and/or handling. Please allow 4-6 weeks for delivery once your complete and legible order is received (special mailing or other arrangements will be made for game tickets or parking passes for which regular mailing times, as determined by Commerce, would not be feasible). Addresses on orders must contain complete cardholder name, street address, apartment or suite number, city, state, correct zip code, account number and cardholder signature. If no address is provided at the time of point redemption, the merchandise or other items will be shipped to the address to which credit card statements are sent.

For any points redeemed for a RoyalsTM Item-2012 that includes tickets for attendance at a RoyalsTM regular season home game or a RoyalsTM spring training home game, should such game be rained-out, weather postponed or is not played for any reason, Commerce and the RoyalsTM will attempt to re-schedule the award to another date but, in the event such re-scheduling is not feasible or cannot be accomplished, Commerce will credit points used for the award to the RoyalsTM Rewards Program Account. Once issued as a RoyalsTM Item reward, such tickets are considered fully redeemed and no refund, exchange or substitution for such game tickets will be made by Commerce nor will redeemed points used to acquire such game tickets be credited to your account. Neither the RoyalsTM nor Commerce are responsible for any lodging, air fare, travel costs or expenses of whatever nature incurred in order to attend a RoyalsTM regular season home game or RoyalsTM spring training home game that is rained-out, weather postponed or is not played for any reason nor for any such costs or expenses for attending a make-up or re-scheduled game.

RoyalsTM Gift cards/certificates are considered fully redeemed once issued. Any RoyalsTM gift card/certificate issued in exchange for reward points must be surrendered at the time it is used, and no photocopies or other facsimiles of a gift card/certificate will be honored. Limitations and restrictions may be placed on the redemption or use of gift cards/certificates, including limitations on the use of unused portion(s) of RoyalsTM gift cards/certificates. RoyalsTM Gift cards/certificates are not exchangeable, refundable, transferable, or redeemable by Commerce or the RoyalsTM for cash or credit and cannot be replaced if lost or stolen. No refunds or any form of cash or credit will be issued for cancellation of arrangements or failure to use RoyalsTM gift cards/certificates. The rewards recipient is responsible for any taxes, fees, assessments or other charges, if applicable to any RoyalsTM gift card/certificate, including any late cancellation fees or other charges. At the sole discretion of the RoyalsTM, gift cards/certificates may not be used for postage, shipping or handling costs or for any sales or use taxes, if any. Gift cards/certificates are void where prohibited by law. Any unused portion of a RoyalsTM gift card/certificate will not be returned as cash or credit by Commerce or the RoyalsTM; however, any unused portion of a gift card/certificate used in Kauffman Stadium may be refunded in cash by the RoyalsTM at the sole discretion of the RoyalsTM. Use of any gift card/certificate is subject to any additional restrictions contained on or with the gift card/certificate. Please see the RoyalsTM gift card/certificate website and/or disclosures for additional terms and conditions, which are subject to change at RoyalsTM sole discretion, if permitted by law.

Should the game for which an Accountholder redeeming reward points for the Game Day Greeting with Commemorative Photo award be rained-out, weather postponed or not played for any reason before the game day greeting is made, Commerce and the RoyalsTM will attempt to re-schedule the award to another date but, in the event such re-scheduling not feasible or cannot be accomplished, Commerce will credit points used for the award to the RoyalsTM Rewards Program Account. The RoyalsTM, in its sole discretion, determines the exact time, location, method and manner of display of the greeting, including the length of time the greeting is displayed. Commerce, in its sole discretion, will consider re-crediting the RoyalsTM Rewards Program Account in the event the greeting is not displayed or the commemorative photo is not taken. Failure of the Accountholder or guests to attend the home game at which the greeting has been scheduled to be, and is, displayed will not entitle the Accountholder to have points re-credited to his/her RoyalsTM Rewards Program account.

Should the game for which an Accountholder redeeming reward points for the Throw Out the Ceremonial First Pitch award be rained-out, weather postponed or not played for any reason before the ceremonial first pitch is made, Commerce and the RoyalsTM will attempt to re-schedule the award to another date but, in the event such re-scheduling not feasible or cannot be accomplished, Commerce will credit points used for the award to the Accountholder’s RoyalsTM Rewards Program Account. Failure of the Accountholder or his/her guests to attend the RoyalsTM home game at which the ceremonial first pitch is scheduled to be thrown will not entitle the Accountholder to have points credited to his/her RoyalsTM Rewards Program account. Failure of the designated RoyalsTM player, if any, to be available for the ceremonial first pitch will not entitle the Accountholder to have points credited to his/her RoyalsTM Rewards Program account.

Neither Commerce, the RoyalsTM nor their third party service providers, their respective employees, officers, affiliates or agents assume any responsibility for, and will not be liable for, any financial loss, personal injury, property loss or damage, other loss, accident, delay, inconvenience, or irregularity which Accountholder and/or guests may suffer by reason of any act, default, non performance or wrongful, careless, negligent, or unauthorized act or omission of any Rewards program supplier, its employees, or any third party.

Neither Commerce nor RoyalsTM their respective employees, officers, affiliates or agents assume any responsibility for, and will not be held liable for any loss, injury, death or damage to any person or property, as a result of RoyalsTM Item reward, or in transit to or from said any such reward or any cause whatsoever due to accidents, delays, cancellation due to nature, mechanical breakdown, strikes, acts of God, inconvenience, or irregularity which you may suffer by reason of a RoyalsTM Item reward. Neither Commerce nor RoyalsTM, their respective employees, officers, affiliates or agents assume any responsibility for any promises or claims, written or verbal, made by anyone other than those made in these RoyalsTM Items Terms and Conditions.

Commerce and RoyalsTM reserve the right to substitute RoyalsTM Items described in this program with other comparable Items of equal or greater value. RoyalsTM Items described or pictured herein may not necessarily be the exact color or have the same features (for example, autographs) due to production variations or manufacturer changes or upgrades and, in any event, all RoyalsTM Items are subject to availability.

All trademarks, service marks and trade names used in the Commerce Bank RoyalsTM Rewards Program are with permission of the respective owners. The names “Kansas City RoyalsTM”, “RoyalsTM”, “Kauffman Stadium” and “The K” alone and in combination with the Commerce Bank RoyalsTM Rewards Program design, are property of Kansas City RoyalsTM Baseball Corporation and the names “Commerce” and “Commerce Bank” are the property of Commerce Bank.
